Welcome to IDYL BV's website ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of www.idyl.com (the "Site") and your purchases from us. By accessing our Site or purchasing products, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or services.

Our store is hosted on Shopify Inc., providing us the online platform to sell our products and services.

2. Lab-Grown Diamond Disclosure

All diamonds sold by IDYL are lab-grown, also referred to as "laboratory created," "man-made," or "cultivated."

Our diamonds are not mined from the earth but are grown using advanced technology, achieving the same physical, chemical, and optical properties as natural diamonds.

By purchasing from us, you acknowledge and agree that all our diamonds are of man-made origin, regardless of whether each individual reference explicitly states so.

If you do not understand or agree to this disclosure, you should not proceed with a purchase.

3. Eligibility to Use the Site

By using this Site, you represent that you are at least the age of majority in your jurisdiction, or have given consent for any minor dependents to use the Site.

You may not use our products for any illegal or unauthorized purpose.

4. Right to Refuse Orders

We reserve the right to refuse, limit, or cancel any order at our sole discretion, including suspected fraudulent, bulk, or reseller purchases.

We strive to display product colors and images accurately but cannot guarantee exact representation.

IDYL BV strives to present images and descriptions of products as accurately as possible. However, we do not guarantee that images (including color rendering) or descriptions are free from minor inaccuracies, and products may differ slightly from the images displayed on the Site.

8. Billing and Account Information

You agree to provide current, complete, and accurate purchase and account information. We reserve the right to refuse or cancel orders if fraud or unauthorized activity is suspected.

9. Delivery and Risk of Loss

All orders are shipped with tracking and delivery confirmation. Once an order is marked "delivered" by the courier, ownership and risk pass to you. If you believe you have not received your order, you must contact IDYL immediately. We will assist in investigating but cannot guarantee refunds or replacements unless the courier confirms a delivery error.

Proof of Fulfillment and Missing Items

As part of our quality assurance process, IDYL BV photographs the contents of each order at the time of packaging. In the event of a dispute regarding missing items, the fulfillment photographs maintained by IDYL will serve as the final and binding evidence of the items included in the shipment.

10. Fraud Prevention and Reporting

We reserve the right to refuse any order suspected of fraud or abuse. In cases of suspected fraud or abuse, we may report the incident to authorities, payment processors, and couriers, and share necessary information as required by law.

False Claims of Non-Delivery or Missing Items

IDYL BV treats false claims of non-delivery or missing items as fraudulent activity. If courier tracking confirms delivery to the address provided and/or IDYL's fulfillment documentation (including photographic evidence) confirms the complete shipment of an order, any contrary claims may be deemed attempted fraud. IDYL reserves the right to refuse such claims, to deny any refund or replacement requests, and to report the incident to the relevant authorities, payment providers, and courier services for investigation and legal action if necessary.

12. Returns and Right of Withdrawal

Refund Processing and Verification

All returned items are subject to verification upon arrival at our atelier. The item must be received in original, unworn condition and pass our quality control inspection. Only after successful verification will the return be approved, and the refund processed to the original method of payment. Refunds are typically processed within five (5) business days following verification.

Return Packaging Condition

All returned items must include the original IDYL packaging, such as gift boxes, certificates of authenticity, pouches, and any other materials provided at delivery. Returns missing these elements may be refused or subject to a partial refund at IDYL’s sole discretion.

Condition for Return Acceptance

Returned items must be unworn, unaltered, and in original condition. Items showing signs of wear, damage, or alteration may be rejected for a refund or may be subject to a partial refund at IDYL’s discretion.

Responsibility for Return Shipping

Customers are responsible for securely packaging returned items. IDYL is not liable for loss or damage of returned goods during return transit.

13. Warranty Policy

IDYL BV provides a two-year warranty against manufacturing defects for all jewelry pieces. This warranty does not cover damages resulting from accidents, normal wear and tear (including scratches), neglect, improper use, or unauthorized modifications. 14. Certificate of Authenticity

Every jewelry purchase from IDYL comes with a Certificate of Authenticity, confirming that the piece has passed our internal quality control and is made with genuine, sustainable materials. IDYL does not provide independent third-party gemological certification unless explicitly stated at the time of purchase.

15. Duties, Taxes, and Customs Declarations

IDYL BV strives to provide transparent pricing for international customers. Duties, taxes, and related fees are included in the final price at checkout for most regions where stated.

If duties or taxes are not included in the final price, they will either be calculated at checkout or may be payable upon delivery, depending on the shipping destination and method.

In the event of a refund, duties and taxes may or may not be refundable, depending on the regulations of the destination country.

IDYL strives for accuracy in duties and tax calculations, but discrepancies may occur due to third-party systems or changes in customs regulations. IDYL is not responsible for additional fees incurred due to such discrepancies.

16. Customs for Canadian Orders

If you are located in Canada, you authorize DHL Express (Canada), Ltd. to act as your agent to obtain customs clearance, with duties and taxes refunded through IDYL under the CBSA CREDITS program.

17. Use of Global-e Services

IDYL BV partners with Global-e, a third-party service provider, to provide secure checkout, payment processing, and logistics services for all orders placed through our website. When placing an order on our Site, you are purchasing from Global-e, who acts as the Merchant of Record for your transaction. Your payment will be processed by Global-e in your local currency. Global-e will also handle shipping, duties, taxes (if applicable), and certain customer service matters related to the order and delivery. 18. Gift Returns

If you received an IDYL product as a gift, please note that only the original purchaser is eligible to initiate a return or request a refund. Refunds will only be issued to the original method of payment used at checkout. Gift recipients may request an exchange or store credit at IDYL’s discretion.

19. Third-Party Links and Tools

The Site may include links to third-party websites and tools provided "as is" without warranties. We are not responsible for third-party content or services.

20. Intellectual Property and Prohibited Use

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without express written permission.

IDYL is not liable for any delays or failures to perform due to causes beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, transportation issues, customs delays, or other force majeure events. Estimated shipping and delivery times provided on our Site are for guidance purposes only and are not guaranteed. We are not liable for delays in delivery once the goods have been handed over to the courier.
